This document is stating unequivocally, that the construction by Israel of a wall in the Occupied Palestinian Territory, including in and around East Jerusalem and its associated regime are contrary to international law. According to the view of the United Nations' principal judicial organ Israel is under an obligation to terminate its breaches of international law, to cease the works of construction, to dismantle the structure built in the Occupied Palestinian Territory, including in and around East Jerusalem and make reparation for all damage caused.
The Party of the European Left also welcomes that the Palestinian people's right to self-determination is explicitly recognised by this document and that the construction of the wall is characterised as a violation of this right. The Israeli settlements, 80 per cent of which have been established on Occupied Palestinian Territory, are also judged as being in breach of international law. The court finally speaks out against justifying the construction of the wall by national security requirements. All states are under obligation not to recognize the illegal situation resulting from the construction of the wall and not to render aid or assistance to it. In view of its special responsibility for maintaining world peace the UN is requested to consider further action to bring to an end the illegal situation, taking due account of the International Court of Justice's Advisory Opinion.
In this document the Party of the European Left sees a confirmation of its principal position that peace and security in the Middle East can only be established, if the relevant resolutions of the UN Security Council are implemented. Only if the Israeli occupation is ended, the right of the Palestinian people to self-determination in a viable, sovereign state side by side with Israel realized, the present violent confrontation can come to a close.
The Party of the European Left requests all its member parties, the GUE/NGL Group in the European Parliament, other parliamentary groups of Left wing parties in the parliamentary assemblies of OSCE, the Council of Europe as well as all peace-loving forces to increase the political pressure on their respective governments to support the implementation of this ICJ decision, in particular through concrete steps in the United Nations general assembly and the UN Security Council.
